Domestic abuse
At Jericho Law we have significant experience dealing with allegations of domestic abuse.
Allegations of Domestic Abuse often come down to one person's word against another. Early engagement of a solicitor to help gather evidence to undermine the prosecution case can therefore be invaluable.
How we can help
The types of allegations that we commonly deal with are:
- Assault
- Harassment
- Stalking
- Controlling and Coercive Behaviour
- Sexual Assault/Rape
At Jericho Law we do not simply sit back and wait for the prosecution to decide whether or not to charge you with a criminal offence. Instead we start gathering evidence to support your defence straight away.
We then carefully draft detailed representations which we submit to the prosecuting authority, such as the Crown Prosecution Service, along with the supporting evidence. Our representations will question the strength of the prosecution’s evidence such as; Can their evidence be used in court? Is their evidence reliable? Are their witnesses credible?
Where applicable, we will also present arguments that a prosecution is not required in the public interest. For example, in some cases a prosecutor may feel that public interest can be met by offering an out of court disposal.
If you have already been charged, our expert team of solicitors and external counsel will forensically examine and prepare your case to ensure that it is presented at the highest level.
Why Jericho Law
Our team has many years of experience in both defending and prosecuting allegations of domestic abuse. Below are some notable cases that Tim has previously worked on:
List of services
-
Coercive And Controlling Behaviour - No Further ActionList Item 1
Tim was instructed to provide pre-charge representation for a client under investigation for controlling and coercive behaviour and assault against his partner. Tim submitted written representations alongside over 200 pages of supporting evidence including character witness statements, text/facebook messages and bank statements to demonstrate that the allegations were entirely false. No further action was taken against the client.
-
Harassment - Successful Appeal Against ConvictionList Item 2
Tim was instructed by a client to appeal his conviction in the Magistrates Court for harassment and stalking of his ex-partner. Tim litigated the case and instructed expert counsel to conduct the appeal hearing. After 2 days of evidence the Crown Court upheld the appeal and the client’s conviction was overturned.
-
Coercive and Controlling Behaviour / Domestic Assault Investigation - No Further ActionList Item 4
We were instructed by our client to provide pre-charge representation in relation to allegations of domestic assault occasioning actual bodily harm along with further historic assaults and coercive and controlling behaviour. We took detailed instructions from our client about the relationship and identified witnesses who could corroborate our client’s account that the complainant was in fact the controlling and manipulative party in the relationship. We obtained several witness statements which significantly undermined the credibility of the complainant. We presented these to the police alongside written representations that the prosecution case did not pass the evidential stage. A decision of no further action was taken against the client.
-
Harassment / Stalking - No Further Action
Tim was instructed to represent a client in police interview for allegations of harassment and stalking against their ex-partner. Through a carefully drafted prepared statement and supporting evidence submitted to the interviewing officer, we managed to ensure that no further action was taken against the client.
-
Assault - Acquittal After Trial
Tim represented a client at trial in the Magistrates Court facing charges of domestic assault. Tim was able to put forward evidence to undermine the credibility of the complainant and following cross examination and closing submissions, the client was found not guilty.
